Terms of Service

1. Acceptance of Terms

By accessing or using ResumeFits (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. ResumeFits is operated as a sole proprietorship located in California, United States.

2. Description of Service

ResumeFits provides an AI-powered resume analysis and improvement service. The Service asks tailored quiz questions based on job descriptions to help users identify relevant experience, then provides resume suggestions and a match score. The Service uses artificial intelligence (Google Gemini API) to generate questions and suggestions.

3. User Accounts

To use the Service, you must:

• Create an account with a valid email address
• Provide accurate and complete information
• Maintain the security of your account credentials
• Be at least 13 years of age (if under 18, you must have parental consent)

You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account at support@resumefits.com.

4. Payment Terms

4.1 Pricing

ResumeFits offers both credit-based and subscription-based pricing models. Pricing is subject to change at any time. We will provide notice of price changes for existing subscriptions.

4.2 Subscriptions

• Subscriptions are billed monthly in advance
• Subscriptions automatically renew unless canceled before the renewal date
• You may cancel your subscription at any time through your account settings
• Cancellations take effect at the end of the current billing period
• No partial refunds are provided for unused portions of subscription periods

4.3 Credits

• Credits can be purchased individually and do not expire
• Credits are non-transferable and non-refundable
• If you delete your account, any unused credits will be forfeited

4.4 Payment Processing

All payments are processed by Stripe. By providing payment information, you authorize us to charge the applicable fees to your payment method. You are responsible for keeping your payment information current.

4.5 Refunds

All sales are final. We do not provide refunds for any payments, including subscription fees or credit purchases, except as required by law or at our sole discretion. If you believe you are entitled to a refund, contact us at support@resumefits.com.

5. User Content and Data

5.1 Your Responsibilities

You are solely responsible for:

• The content of resumes and job descriptions you upload
• Ensuring you have the right to upload and share such content
• The accuracy of information you provide to the Service
• How you use AI-generated suggestions and recommendations

5.2 License to Your Content

By uploading content to the Service, you grant us a limited, non-exclusive license to use, store, and process your content solely to provide the Service to you. We will not share your resume or job descriptions with third parties except as necessary to provide the Service (e.g., sending content to Google Gemini API for processing) and as described in our Privacy Policy.

5.3 Data Deletion

You may delete your account and all associated data at any time. Upon account deletion, your data will be permanently removed from our systems within 30 days, except as required by law or as retained in backup systems for a limited time.

6. Prohibited Uses

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Upload content that infringes on intellectual property rights of others
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to the Service or related systems
• Use automated systems (bots, scrapers) to access the Service without permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Resell, sublicense, or redistribute the Service without written permission
• Use the Service to harass, abuse, or harm others
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the Service or servers

7. AI-Generated Content Disclaimer

The Service uses artificial intelligence to generate quiz questions, resume suggestions, and match scores. You acknowledge and agree that:

• AI-generated content may contain errors, inaccuracies, or inappropriate suggestions
• You are solely responsible for reviewing and using AI-generated suggestions
• We make no warranties about the accuracy, completeness, or suitability of AI output
• AI suggestions should be used as a starting point and reviewed by you before use
• We are not responsible for any consequences of using AI-generated content in your resume or job applications

YOU USE AI-GENERATED SUGGESTIONS AT YOUR OWN RISK. WE STRONGLY RECOMMEND REVIEWING ALL AI-GENERATED CONTENT BEFORE INCORPORATING IT INTO YOUR RESUME.

8. Intellectual Property

The Service, including its software, design, text, graphics, and other content (excluding user-uploaded content), is owned by ResumeFits and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our express written permission.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, for any reason including:

• Violation of these Terms
• Fraudulent or illegal activity
• Failure to pay fees
• Extended periods of inactivity
• At our sole discretion

Upon termination, your right to use the Service will immediately cease. You may also terminate your account at any time by deleting your account through the Service.

10. Disclaimers and Limitation of Liability

10.1 No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, timely, secure, or error-free
• The results from using the Service will be accurate or reliable
• Any errors in the Service will be corrected
• AI-generated suggestions will improve your job search outcomes

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESUMEFITS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service, including AI-generated suggestions
• Unauthorized access, use, or alteration of your content
• Any job application outcomes or employment decisions

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO RESUMEFITS IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10.3 Career Outcomes

WE MAKE NO GUARANTEES REGARDING JOB SEARCH OUTCOMES, INTERVIEW INVITATIONS, OR EMPLOYMENT OFFERS. THE SERVICE IS A TOOL TO ASSIST WITH RESUME IMPROVEMENT, BUT HIRING DECISIONS ARE MADE BY EMPLOYERS BASED ON NUMEROUS FACTORS BEYOND OUR CONTROL.

11. Indemnification

You agree to indemnify, defend, and hold harmless ResumeFits and its operators from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you upload to the Service
• Your use of AI-generated suggestions in your resume or job applications

12. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Service prior to the effective date of the changes. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in California. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

Notwithstanding the foregoing, we may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of our intellectual property rights.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ResumeFits regarding the Service and supersede all prior agreements and understandings.
